Timor-Leste: Political Independence but Economic Dependence

Timor-Leste defeated Indonesia's 24 year long occupation, but is increasingly economically dependent and dominated by its former occupier.

After 13 years of international presence in Timor-Leste and ten years since the restoration of independence the country now has to turn to Indonesia to help free its people from poverty.  Western countries that helped Timorese gain independence are not investing its in economic development other than through ineffective aid projects.

Despite 14 billion dollars from donor countries and UN being spent on developing Timor-Leste and billions more from the Petroleum Fund Timorese people remain among the poorest in Asia.

The Government, under Prime Ministers Alkatiri, Ramos-Horta and Xanana Gusmao, have consistently stated that justice for the crimes of 1975-99 are not as important a priority as freeing the people of the Timor-Leste from poverty.  The Timorese Government was unable to free its people from poverty in partnership with the wider international community; it is now turning to the old enemy to develop Timor-Leste.

Since 2008 the expansion and deepening of relations with Indonesia has grown dramatically.  The Indonesian business community in Dili has grown both in size and influence. It is developing dominance in critical national infrastructure development along with many other areas.

1. Petro sector: Timor-Leste depends almost entirely on Indonesia for supplies of fuel.  And recently Indonesian state oil company Pertamina signed an agreement with new Timor state oil company TimorGAP to dominate the petrol station sector across all districts. Prime Minister Gusmao has also consulted widely with Indonesian actors in East Java in developing the South coast supply base as part of the Tasi Mane mega project.

2. Recently, TELIN a subsidiary of Indonesia’s state owned and largest telcoms company TELKOSMEL won a license to operate a telcoms network in Timor-Leste.

3. Indonesian operators Merpati and Batavia dominate the air transport sector in Timor-Leste.

4. Indonesian bank Mandiri is the preferred financial institution for unregulated financial transactions by Indonesian businesses with their Timorese partners.

5.  Indonesia’s shipping hub in Surabaya dominates shipping routes to and from Timor-Leste.

6.  Indonesian educational institutions remain the preferred destination for the majority of Timorese university students.

7. Indonesian government departments are rapidly becoming the dominant development partners for all of Timor-Leste’s ministries to improve the civil service.

8. The Indonesian national police service is expanding its cooperation and assistance to Timorese national police.

9. In a dramatic and important move in 2011 after the visit of former Vice President and Commander of the Indonesian military General Tri Sutrisno, the opening of Timorese and Indonesian military cooperation has begun in earnest.

10.  Indonesian suppliers are already providing a range of non-lethal material to Timorese security institutions, and weapons and ammunition transfer are inevitable.

11. Indonesian business played a key role in financing a number of political parties in the recent national elections.

12.  While the Government is spending billions on reconstruction of Timorese infrastructure that was destroyed by the Indonesian army and its Timorese allies, the vast majority of building supplies are Indonesian in origin.

13.  Timor-Leste is now receiving thousands of Indonesian migrant workers who are beginning to dominate certain areas of the labor force and service industries.

While Timorese dollars flow eastwards to Indonesian businesses that profit from increased cooperation many people ask how long does the Timorese population have to wait for substantive justice and reconciliation?  The Indonesian establishment still finds it hard to return the remains of Nicolau Lobato and many other disappeared heroes such as Mau Hudo, David Alex, and Sabalae.

President SBY, who has shown himself to be sympathetic to Timorese feelings on these matters has also proven to be unable to generate results.  With Prabowo Subianto being the current front runner to replace SBY things will possibly become more complicated.

Given that Indonesia is not only benefitting from Timor-Leste reconstruction and that it is exerting economic dominance, in addition to longstanding Timorese patience, it is important that old wounds be closed while the opportunity still exists.

TAUR CONCERN WITH THE VIOLANCE AND SAY SORRY TO THE COUNTRY

The parliamentary election, which ran on the 7th of July, 2012, were very successful and our nation chose and voted for 4 political parties. Even though after the CNRT Conference on July 15th the CNRT members rejected the party to coalition with FRETILIN the violence erupted the capital of the nation and several districts of east Timor. 



During last monday violence almost one hundred cars been stones more then dozens hospitalize, one dead, some house been burnt including schools building after CNRT vote for FRETILIN to remain as the opposition party for the second term.

During the recent parliamentary electoral process the international community and the President of the Republic saw the following concern – of whether the outcome of this election will be accepted by those who may not be successful.

“Sadly, the violence that took place on July 15th did not come from those who were unsuccessful in the parliamentary elections but rather have come from those who won. This is something that the President was not prepared for and therefore is concerned,” Taur express his concerned.

A day after (16/07) the violence erupted in several districts in East Timor, President of the Republic met with the President of CNRT, the President and Secretary-General of FRETILIN, the Secretary-General of PD and Deputy President of FRENTE- MUNDANSA which successful parties of the parliamentary election). The President of the Republic shared with them his concerns of the violence which took place and asked for their support to appeal to their members to each contribute to a calm and peaceful situation in our country.

Taur Matan Ruak said, “violence is not the way to democracy! We all condemn violence!”

Former East Timor Defence force commander furthermore stated, “there is no justification to use violence as a measure to resolve issues. There are political and democratic means to find a way to move forward.”

The four political parties leaders have all pledged to support the President to maintain a calm situation so that once again Timor- Leste can truly show to the world that they are able to move forward on theur own as a nation.

The President Taur, expresses his solidarity with those victims in the violence and apologises to all those who have felt offended, and felt effected in this stage where Timor-Leste is strengthening her democracy to move ahead.

As the President I ask once again that we all are understanding and help each other. What has already passed to put behind us and move forward, to walk together, to raise the profile of our nation and to elevate our dignity.
Once again, I thank you all.

Answered the questions from the journalist on the issue of coalitions between the parties may changed after the violence, Taur said, “President of the Republic does not influence political parties to choose whatever options they may want to choose to lead the nation in the coming five years. The President, in accordance with the mandate, swears in the new Prime Minister and the government of the people - the most voted party with the coalition they may want to choose. The final results shall be declared and published in the nations Official Bulletin. Soon we may see what will happen, whether if what has come out of the CNRT conference will be maintained or otherwise - the President is available. From there the President will announce accordingly. However, all of this will be based on the mandate the Constitution has afforded him.”

He continues, “very soon we are embarking on the process for our new Legislature and the next Constitutional Government and this will begin next month, in August 2012.”

Despite the violence Taur confident that UNMIT still going to leave in the end of this year. “Following this will be the negotiations and subsequent mandate of the UN’s next missions which will be very different to the current one.”

East Timor President thanks to the contributions of everyone – political parties, state institutions, the international community, civil society, religious convictions, security and defense institutions and the people - all have contributed greatly.

“As the President of the Republic, I thank you all. And I ask that the entire nation, all institutions, in collaboration with the President continue preparing for the processes to come to be successful in Timor-Leste’s history,” said Taur.

East timor President also congratulates the four parties who’ve won during the recent parliamentary elections. And the President expresses his admiration and solidarity and complete respect to all the political parties and coalitions that were unsuccessful in this race to maintain their presence in the coming legislature.

During the electoral campaigns of the parliamentary elections were contested by 18 political parties and three coalitions and they were able to go out to the entire nation to inform them of their respective programs and policies.

Xanana Prefers CNRT be the Opposition, or to Govern with a strong Opposition.

Today CNRT is holding  a national Conference held in the Dili Convention Center from 10am-5pm.

At this conference the President of CNRT Xanana Gusmao has stated indicated that a grand coalition with FRETILIN is not his desired option for the formation of the next Government of Timor-Leste.  But he seeks party consensus.

CNRT was second most voted party in 2007 and is now the first most voted party. Xanana congratulated his followers.   He told party members “that we are very successful during the last five years. Even though we did not win 50 plus 1 % to run the government alone we did win 30 seats.”

Xanana offered three options to the CNRT conference to discuss and decide the best option.  But Xanana indicated that it is his intention to have a strong opposition in the Parliament, which he also indicated that in his first option for the participants to think if CNRT wants to go to opposition. 

Xanana told his party member to choose to have a coalition with FRETILIN or PD and Frente Mudanca.

If the coalition of CNRT and FRETILIN is chosen it will have 55 seats in parliament and leaving PD and Frente Mudanca to opposition with ten seats. Xanana appealed to CNRT party members to discuss the impact of this coalition to the country’s democracy.

The second option is the coalition of CNRT, PD and Frente Mudanda which will have 40 seats in the Parliament. Xanana asked the participants to discuss on the performance of the five years experience of governing together with these parties considering the positive and negative aspects closely.

The CNRT conference participants are from all 13 districts. Eash district has 3 party senior members as representatives and 2 party members from each party of Timor-Leste’s 65 sub districts.

Xanana also appealed to the Defense force and Police to remain its neutrality not to intervene in the political matters.  “We don’t want to say to international community that we still need ISF and UNMIT to remain in the country.”

He also stated that Timor-Leste has in its interest to strengthen its democratic system as we always said “Check and balance,” is what we want and what we need.

“During the last five years our institutions played a fundamental role to keep check and balance. Whenever there is no check and balance system, totalitarianism which excessively close us to dictatorship is a danger.  Because of this we want a strong opposition, to help keep the State in check.” said Xanana.

But the party not able to gain an absolute victory to govern alone to implement those program which the party wants to implement.  IN the last 5 years CNRT has been able to defeat all the old parties including the historical and largest party, FRETILIN.

The Timor-Leste constitution said the government only ne formed by the party that wins the election. But if none win 50%  plus one the government can be formed by a coalition of parties forming a majority in Parliament.

In 2007 Fretilin was the first most voted party with 21 seats in Parliament. As the winning party FRETILIN was not able to form a majority coalition, so the President allowed CNRT as the second most voted party to form a government coalition with PD, PSD, ASDT and UNDERTIM.  Only PD remains, as PSD, ASDT and UNDERTIM were not able to win enough votes on the 7 July election to remain in Parliament.

Xanana stated that “In this 2012 election CNRT won 30 seats and FRETILIN 25, PD 8 and FRETILIN Mudanca 2. Because of this reason I have proposed several alternatives.  Firstly, we have always said if we cannot win 33 seats in Parliament lets go to Opposition. Xanana said if CNRT choose this option naturally FRETILIN and PD will form a coalition, which will have a majority in parliament with 33 seats, so they have right form the Government”.

Some analyst applauded the CNRT conference, which is televised life by TVTL. “This is a great show of democracy,” said an academic from East Timor National University which asked not to named.

Timor-Leste Sues ConocoPhillips for Hundreds of Millions, Possibly Billions.

Just 3 days after the national elections, and confident of its future electoral mandate, the Government of Xanana Gusmao has announced that it is launching legal action against US oil and gas company ConocoPhilipps and others.

Timor-Leste's Petroleum Fund of over 11 Billion USD is almost entirely generated by the Bayu Undan project currently being operated by ConocoPhillips.

According to the Government press release from yesterday, Secretary of State for Natural Resources (Alfredo Pires), who is also a member of Xanana's CNRT party, stated that “It is a David and Goliath fight”, said Secretary of State for Natural Resources Alfredo Pires, adding that “hundreds of millions, possibly billions” is owed.

Tempo Semanal sources indicate that the Government is seeking to not only obtain back taxes but also to pressure Conoco into greater cooperation on proposed south coast oil and gas supply base engagement.  The Government also wants to ensure Conoco improve its development local businesses more serious as part of their engagement with Timor-Leste.  Despite claims its website that it engages with local business worldwide it does not do much in Timor-Leste.

Timor-Leste confirms action underway to reclaim taxes

The Democratic Republic of Timor-Leste is engaged in legal action against multinational oil companies Conoco-Phillips and others to recover substantial monies it believes are rightfully owed the people of Timor-Leste under legal obligations stemming from production contracts in the JPDA, Joint Petroleum Development Authority. U.S. Ambassador and lawyer Pierre-Richard Prosper has been engaged to advise and represent the Democratic Republic of Timor-Leste on matters related to the Petroleum sector, investment and infrastructure development. After audits by the relevant authorities in Timor-Leste 28 assessments have been made against oil companies.
Ambassador Prosper confirmed that “as part of that auditing process they (the relevant authorities) are discovering that there are large areas where there were discrepancies”.
“It is a David and Goliath fight”, said Secretary of State for Natural Resources Alfredo Pires, adding that “hundreds of millions, possibly billions” is owed. Under the terms of the JPDA, 90 per-cent of revenue is owned by Timor-Leste while the remaining 10 per cent is due to Australia. Ambassador Prosper urged Australian Taxation Office ATO officials to conduct similar due diligence audits of the revenues paid to it so far.

“I would assume they should be equally interested to find out if the companies are paying the appropriate taxes.”
Timor-Leste believes that in order for full disclosure and harmonization of taxation in the JPDA it remains in the interests of the Australian taxpayer for a taxation sharing Memorandum of Understanding to be signed between both nations. “In order to do the math, in order for Australia to be fully satisfied that taxes have been paid it is important to know what has, and what has not been paid, because you need the numbers to add up. In other words, there is a piece of the equation that is missing for both Timor and Australia and it makes sense that a tax authority, be it in Australia or Timor, would want to have that complete in order to come to a conclusion as to whether or not all taxes have been paid,” said Ambassador Prosper.

Mindful of the current debate in Australia about illegal migration, Ambassador Prosper re-iterated the Timor-Leste government view that there are strategic benefits for Australia in securing the economic future of its near neighbor. A key policy position of the Timor-Leste government is that a pipeline bring oil and gas from the Greater Sunrise field onshore Timor-Leste, to boost the jobs and opportunity in the country.
“We do not want to have a situation where there is a country to the north that is unstable,” said Ambassador Prosper, adding, “you want a country to the north that is a partner in trade, a partner in peace, so that you do not have chaos and migration issues that often sometimes plague this part of the world. “ENDS
